Successfully implementing efficiency measures with guaranteed savings
The dena guide entitled ‘Energy performance contracting – successfully implementing efficiency measures with guaranteed savings’ provides up-to-date information and sample documents for the preparation, development and tendering of an energy performance contracting project free of charge. dena commissioned the law firm Maier Rechtsanwälte PartGmbB to prepare the report, and numerous industry experts were also involved in the revision process.
All documents were revised in 2023 and updated in 2024 (legal status: May 2024):
The guide has been adapted to new laws and funding guidelines, and the documents and Excel tools have been improved (see below – each indicated in the list). A new sample document for the participant application will be made available. The Excel tool for evaluating bids can now be used to create a profitability comparison with in-house realisation; the bid comparison is also possible with negative net present values.
Contents of the guide
The first chapters of the guide contain detailed explanations of the energy performance contracting, while the subsequent chapters provide a classification of the legal situation and funding programmes. These chapters will be updated regularly in the future. The implementation of all phases of project development is described step by step in the following chapters:
- Start (orientation consultation)
- Preparation (rough analysis, invitation to tender)
- Negotiation (award)
- Implementation (detailed analysis, guarantee phase)
The savings guarantee contract (model contract) is concluded between the client, such as the municipality, and the energy performance contractor and regulates the liabilities over the period of the main service or guarantee phase. The model contract must be adapted in detail to the specific project and covers all project phases from the conclusion of the contract.
